Terms & Conditions

The terms on which MyTsmall Designs supplies design services. A signed quotation together with these terms forms our agreement.

Quotations

Quotations are valid for 30 days and are based on the scope described in them. Work that falls outside that scope is quoted separately and in writing before it is started — you will never receive an invoice for work you did not agree to.

Deposits and payment

A deposit is payable to book the work in; the balance falls due on approval, before final artwork is released. Invoices are payable within the terms stated on the quotation. We reserve the right to suspend work on overdue accounts.

Your material

You confirm that any text, photographs, fonts or logos you supply are yours to use, or that you have permission to use them. We cannot be held liable for third-party claims arising from material supplied to us.

Concepts and revisions

Concepts are presented for your selection. We refine the chosen direction with you until it is right; a change of direction after a concept has been approved is a new piece of work and is quoted as such.

Ownership

Ownership of the final approved artwork, including editable source files where the quotation says so, passes to you once the account is settled in full. Until then it remains ours. Concepts not selected remain our property.

Portfolio use

We may show completed work in our portfolio, on this website and on social media. If a project is confidential, tell us and we will keep it out.

Print and third parties

Where we supply artwork to a printer, signage company or other third party, responsibility for the finished product rests with them. We will replace artwork that is genuinely at fault, but we are not liable for a supplier's production errors or for costs arising from them.

Proofing

Please check proofs carefully. Once you approve artwork in writing, responsibility for errors that survive that approval — including spelling, contact details and prices — passes to you.

Liability

Our liability in respect of any project is limited to the fees paid for that project. We are not liable for indirect or consequential loss, including loss of profit or business.

Governing law

These terms are governed by the laws of the Republic of South Africa.
